Friends of the Santa Clara RIver v. Castaic Lake Water Agency (2002) 95 Cal.App.4th 1373

The Castaic Lake Water Agency prepared a project EIR analyzing the impacts of a proposed water transfer. The EIR relied in part on the program EIR prepared for the Monterey Agreement /State Water Project. After the Castaic Lake Water Agency approved its project, the Third District ruled that the Monterey Agreement EIR was inadequate. (Planning and Conservation League v. Department of Water Resources (2000) 83 Cal.App.4th 892.) The Second District then held that invalidation of the first-tier EIR rendered the second-tier EIR invalid, and that error was prejudicial.
